Travel conditions
Dear AMICAL alpin travel participant!
In your and our interest, we would like to lay out the following legal conditions which make up our contractual agreement. Once you have signed up for one of our tours the following conditions apply.
Booking Form
1. Who can Participate?
Anyone can participate who is healthy and can fulfill the special requirements listed in the travel description and who can bring their own appropriate gear with them. A detailed list of gear that you need to bring will be sent after your booking confirmation. The leader of the travel group or the person responsible to lead the group reserves the right, at the beginning or during any given tour, to partially or completely remove any participant from the group who cannot fulfill the rigors and requirements of the program. In the event that a participant is not allowed to continue, no refund or partial refund will be possible.
2. Payment
The written booking confirmation that you will receive is a binding contract for you and for us. A booking invoice will be sent out with the written confirmation. Within 14 days of receipt a deposit of 100,- EUR for alpine tours, 400,- EUR for hiking tours and 600,- EUR for expeditions must be paid. Should the amount exceed 20% of the tour price, so the amount of the deposit is limited to this The remainder of the invoice is due in full, without a reminder from our side, at the latest, 30 days before the tour begins.
The remaining amount may be required prior the end of the journey only if AMICAL alpin has handed out an written confirmation according to § 651k Abs. 3 BGB. For this reason AMICAL alpin is insured with R + V Versicherung AG (insurance company).
Should a trip be booked 30 days before the beginning of the tour, the invoice must immediately be paid in full.
In the case of late payment although the participant has received the written confirmation, we reserve the right to cancel the contract after an appointment of a date. The participant must then pay the usual cancellation fee like agreed in section 8, when he does not have the right not to pay.
3. Our Service
The scope of our service can be reviewed in detail in our travel information. After you have booked, you will receive a booking confirmation, detailed information, a gear list, insurance forms. Guides, course and travel leaders are UIAGM internationally certified mountain and ski guides or are similarly qualified travel guides. Following the instructions of the leader during the tour is an absolute requirement. If you decide to end the tour early, any additional costs incurred as a result will be at your own expense. Our prices for courses and guided tours in the Alps have been calculated and are based on Alpine club member prices. If you are not a member of an Alpine club, the additional costs for lodging, huts and meals must be paid directly at the hut by the participant. The described tour in our program is the planned itinerary of the tour; however, we cannot guarantee that the same plan can be followed in detail. Secondary agreements, which the participant lists in the special agreements section of the booking form, must be confirmed in writing and will be sent (upon agreement from AMICAL alpin) along with the booking confirmation.
4. Participant Insurance
Please check your insurance coverage. Included in the travel price is a travel cancellation insurance which will cover costs incurred by a cancellation which falls under general insurance guidelines. We suggest you get a travelers insurance package. For this purpose we are sending you, along with the booking confirmation, information and forms. This is a voluntary insurance and must be paid by the participant.
5. Minimum Group Size
The tour can only take place when the listed minimum number of participants per group has been reached. If the price for the tour has been listed according to differentiated group sizes, the smallest listed group size is the minimum participant number. If the minimum participant number has not been reached, we reserve the right to cancel the tour up to two weeks before the tour begins, in this case you will get the full price back. In the event that the participant/s still wish the tour to be offered, the price situation of the tour will have to be adjusted. The newly calculated price will be sent to the participant and in some cases a new contract. If the potential group members agree to the new conditions and wish the tour to proceed, the new contract will be the basis of the continued tour.
6. Documents and Health Regulations
As far as it is possible for us, we will inform you as to important changes in the detailed information concerning general health and other regulations before a tour commences. Participants are responsible for taking care of and paying for passports, customs, foreign exchange dealings, and health regulations (vaccinations, etc.) All costs and disadvantages which arise from not following the regulations are your responsibility, also when these regulations change after the tour has been booked.
AMICAL alpin is not liable for the timely issuance and access of visas through the respective diplomatic representation in case the participant has AMICAL instructed with the procurement, except AMICAL alpin is responsible for the delay.
7. Service and Price Changes
The listed prices represent the actual price at the time the program is printed.
According to § 651 a Abs. 4 and 5 BGB AMICAL alpin reserve the right to change the listed prices up due to important unforeseen reasons like increment of carriage costs, charges for airport taxes, kerosene, visa fees or change of the exchange rate:

Increases after the conclusion of the travel contract of carriage costs and in special the costs for kerosene, charges for airport, the price will change as follows: Seat-related increases can be transmitted proportionally to a participant. In other cases the additional or increased costs of carriers or of each means of transport is divided due to the number of seats or beds.
The calculated additional costs per seat, AMICAL alpin can pass on to the participants.

AMICAL alpin can charge increased fees on conclusion of the travel contract like airport charges to the participants in proportion.

Changing exchange rates after completion of the travel contract, AMICAL can pass on to the participants to the extent that such additional costs incurred.

A price increase can be passed only if between the completion of the travel contract and the agreed travel time are more than four months and the circumstances leading to the increase have occurred after completion of the travel contract and not foreseeable for AMICAL alpin.

If it comes to a subsequent change of the price, AMICAL alpin is obligated to inform immediately the participant. Price changes at the expense of the participant are only allowed and required if they until 21 days prior to travel.
In case of a considerable change of an essential travel service or should the price be raised by more than 5 percent the participant has the right to cancel the contract, free of charge. The participant can demand to take part in an equivalent travel from the program, if it is possible for AMICAL alpin to manage without further costs. The participant has to enforce this right immediately upon receipt of the statement against AMICAL alpin.
Flight plan changes, changes in itinerary or changes in the mode of travel may occur due to technical reasons or as a result of unforeseen circumstances or in the best interest of a smooth transition.
8. Cancellations
Participants can cancel a tour at any time before the tour begins. In your own interest you should do so in writing and send it by registered letter. Your cancellation will go into effect on the day we receive the concerned letter. If the cancellation arrives 46 days before the tour begins in case of alpine tours and climbing courses an administrative fee of 80,- EUR will be charged; in case of trekking tours we charge 5 % of the entire travel cost. If the cancellation arrives 61 days before the tour begins in case of expeditions we charge 5 % of the entire travel cost.
Should the cancellation occur less than the above mentioned days before the tour starts, we will have to charge the following listed percentage of the entire travel costs:
Alpine tours and climbing courses:
• up to 46th day: 80,- EUR
• 45th to 15th day: 50 percent
• 14th to 7th day: 60 percent
• after the 6th day: 70 percent
• no-show: 95 percent
Hiking tours and trips:
• 45th to 30th day: 15 percent
• 29th to 15th day: 35 percent
• 14th to 7th day: 50 percent
• after the 6th day: 70 percent
• no-show: 95 percent
Expeditions:
• up to 61th day: 5 percent
• 60th to 30th day: 35 percent
• 29th to 15th day: 50 percent
• after the 14th day: 70 percent
• no-show: 95 percent
The participant may feel to lead the proof that in connection with the resignation or non-beginning of the tour none or lower costs have originated. A participant who, no matter what the reason, leaves the group early, has no right to receive a refund of any kind. In case AMICAL alpin is arranging a charter or scheduled flight for special conditions we have to use the cancellation fees of the respective airline plus processing fees. About this cost we can inform you in advance; and it might be up to 100% of the flight costs.
9. Contractual Annulment due to Extraordinary Circumstances
Should a tour be impaired, endangered or impossible to complete due to extraordinary circumstances out of our control (war, strike, upheavals, epidemics, etc.) the participant and AMICAL Alpin have the right to cancel the contract. This is also the case should a tour, through exceptional circumstances (avalanche danger, extreme weather conditions, return due to injury of a participant, etc.) be halted or if the tour is not able to begin. Extra costs due to an eventual retreat or return home must be covered in full by the participant. Of course, we will return your money minus processing fees if we are able to cancel the tour with our service providers.
10. Liability
We are liable, within the scope of our insurance coverage for mountain schools, for persons, things and property which have been damaged as a direct result of an extremely careless action on the part of one of our tour-leaders. Concerning all other general legal liability matters, the participant goes on the tour at his/her own risk. Mountain tours are led by qualified guides, however, participants go on and take part in these tours under their own responsibility and at their own risk. The leader or guide of the group has the right to change the tour as a result of: the knowledge of the participant/s, their technical expertise and their general fitness (see paragraph 9).
For damage which is not physical damage, the liability from AMICAL alpin is limited three times of the travel price:

so far as the damage from the traveler has been caused neither willfully nor with gross negligence or

so far as the tour operator is guilty for the damage caused to a passenger through a fault of a service provider.
11. Loaned Gear
Repair costs of loaned gear which have been damaged beyond the normal wear and tear of the property must be covered by the participant. Lost material must be replaced by the participant.
12. Exclusively for Tours in the Alps, Single Tours, Winter Tours or Special-Week-Tours:
Concerning Bad Weather Days
The difficulty of the planned tour (week) should coincide with the weather conditions. If bad weather predominates, both sides should agree upon and go to an alternative site where weather conditions are better. If this is not possible and the tour (week) must be partially or completely cancelled, we will pay 50 percent of the guides costs and in the case of a package tour we will return 100 percent of the external service costs which have not been used. If the tour has already begun and the tour must be cancelled earlier than usual due to bad weather conditions, we will pay 30 percent of the guides fee and in the case of a package tour we will pay back 100 percent of the services which have not already been used.
13. Ineffectiveness
The ineffectiveness of any one paragraph or point in the tour/travel contract has no effect on the entire travel contract.
14. Organizer
The organizing service provider is AMICAL alpin GmbH & Co. KG, business leader Dominik Müller,
UIAGM internationally certified mountain and ski guide, 87561 Oberstdorf, Tel.: +49 (0)8322- 9874788, Fax: +49 (0)8322- 9874787 in cooperation with all IATA-Flight services and several renowned travel agencies.
All tours are planned conscientiously and precisely by our staff. However, we cannot guarantee a summit or the realization of subjective expectations or successes of the participant, especially as our trips are dependent on the weather.
15. Legal Venue
The participant can only sue AMICAL alpin on his legal domicile.
